The use of forensic computer animation used as evidence has exploded, bringing with it challenges to traditional principles of evidence admissibility. As offered, these computer created animations purport to demonstrate how a certain event did or did not occur. The unique characteristic of these animations is that they act as a means to synthesize all the evidence presented at trial into one visual representation. Their use can be either greatly effective or unfairly prejudicial. Animations allegedly demonstrating how an act did or did not occur can have tremendous persuasive value in the minds of the jury. Instead of forcing the jury to integrate every theory and piece of evidence into one seamless mental thought, a forensic animation seemingly combines all pertinent facts into a visualized theory of the truth. While these animations are merely representations of theories, the jury will often accept them as the truth of the matter due to their highly persuasive and prejudicial value. In one key study, 82% of trials where animation has been introduced as evidence has led to victory for the moving party. The key to arguing for or against the admissibility of computer forensic animation lies in the attorneys ability to understand the standards of admissibility applied to such evidence. Computer animation can generally be broken down into two differing classes of evidence, each with its own standard of admissibility: Computer generated evidence as demonstrative evidence: When arguing in favor of the admissibility of computer generated evidence, the best argument to make is that the evidence is merely demonstrative. Demonstrative evidence inherently carries no independent probative value and is used for five general purposes: (1) to educate your audience; (2) to explain something; (3) to persuade your audience of something; (4) to dissuade your audience of something; and (5) to reinforce something your audience already believes. Arguing that your computer generated evidence is merely demonstrative evidence directs the judge to use the low relevance standard in determining its admissibility. After categorizing the evidence as demonstrative evidence, the judge will then ask the following questions in order to determine its admissibility: Is it relevant? Does it have a tendency to make the existence of any fact that is of consequence to the determination of the action more probable or less probable than it would be without the evidence? . F.R.E. 401 (2006). Does it aid the trier of fact in understanding pertinent information? Does it accurately reflect the elements of the situation it is portraying? If the evidence is deemed as demonstrative and the answers to the preceding questions are all in the affirmative, the evidence will be admissible, provided that its probative value is not substantially outweighed by the danger of unfair prejudice. F.R.E. 403 (2006). This low threshold test will allow for the admissibility of most demonstrative evidence. The key to getting your computer animation evidence in is to argue that it falls within one of the five general categories of demonstrative evidence. The successful attorney must know the tests and the questions to ask, and have the ability to persuade the judge that the evidence being offered is subject only to the general relevancy standard in order to gain admission into evidence. Computer generated evidence as simulation (substantive) evidence: When arguing against the introduction of forensic animation, the better choice is to argue that the animation constitutes simulation evidence, requiring a higher standard of admissibility. Computer simulations are seen as blurring the line between demonstrative and substantive evidence. Simulation evidence is highly effective because it allows for complicated facts, data and evidence to be extrapolated into one visual demonstration of every piece of relevant evidence. Because of the role that humans play in the creation of computer animations, judges will often view such animations as substantive evidence, requiring the expert creating the animation to take the stand in order to allow for cross examination. When arguing that a computer animation is simulation evidence, the arguing attorney must focus on its technical aspects and the role that humans played in the selection and interpretation of data used to create the animation. Once deemed simulation evidence, the judge will then consider three primary inquiries: Is the underlying scientific principle valid? Considering whether the principle has been tested, its error rates, and the degree of the principles acceptance in that particular scientific community . F.R.E. 401 Is the technique applying the scientific principle valid? Was the technique applied properly on this particular occasion? Each of the above questions requires extensive and substantial inquiry into the quality and characteristics of the evidence attempting to be introduced. In order for simulation evidence to be admissible, it must be more than relevant. In addition to meeting the three tests stated above, only evidence which has been proven or stipulated to as true may be included in the simulation. This higher admissibility standard is due to the highly prejudicial value of such simulation evidence. Notwithstanding its admissibility as simulation evidence, the evidence can still be barred if it fails the Rule 403 unfair prejudice analysis. The Rule 403 unfair prejudice argument is the last bow in the quiver for the attorney arguing against the admissibility of computer animation evidence and should only be focused on as a last resort. As you can see, categorizing computer forensic animation as demonstrative or simulation evidence will, for the most part, determine its overall admissibility. These differing standards of admissibility are to be used as a means of argument, depending on the attorneys role in the case. When preparing for such an argument it is important to keep in mind the opposing position and to be prepared to argue against it. By Michael Russell The Feldenkrais Method (FM) was first taught in the 1950s by Moshe Feldenkrais, who had a doctorate in science from the Sorbonne, but studied many other subjects, including martial arts, prenatal development, cybernetics and linguistics. It has two components, Functional Integration and Awareness Through Movement. Functional Integration consists of one-on-one sessions which begin with the practitioner’s assessing how the client sits, stands and moves. Then the practitioner begins to gently move different parts of their body. These movements start out small, but get larger as the session proceeds. They are never intended to be painful, because pain will inhibit movement. The client’s only participation in the session is to notice how they feel when different parts of their body are moved in different ways (and of course inform the practitioner if any movement causes pain, so it can be stopped or changed). After a treatment the client may notice that they sit, stand, or move differently, or perhaps they just feel more relaxed. Awareness Through Movement is done in groups, with one practitioner and many clients/student. In one of these classes the practitioner has the students perform certain movements, asking questions throughout the class to help the students pay attention to what is happening in their bodies and how they feel as they move in certain ways. The Feldenkrais Method has many uses. It is good for people recovering from an injury because it can teach them how to move in a way that does not aggravate the injury or increase their pain. Everyday items such as frames, keepsake boxes, toy boxes, hope chests, even lamps and framed mirrors become extraordinarily beautiful with the addition of raised designs. Raised designs not only add pattern to plain surfaces, but also texture, creating a design that can be felt when touched, that casts a shadow as the light changes in the room, and that can be embellished with any form of paint or faux finish you choose. In most cases, standard craft stencils are not thick enough to create a noticeable 3 dimensional pattern on a surface. You can find stencils that are cut of much thicker material and especially made for raised plaster stenciling on numerous websites on the internet for use with dimensional mediums such as common joint compound, stencil paste and other products now carried your local paint and craft stores. If you can frost a cake, you can do it! Step 1: Simply tape your stencil to your wall or intended project. Step 2: Using a flat edged scraper, apply a thin coat of common joint compound (also known as wall mud) over the stencil openings. Be certain that all openings have been completely covered. Step 3: Once all of the openings have been sufficiently covered, you may now apply a bit more compound to create a higher raise. It is not advisable however, to exceed a depth of since the action of removing the stencil could distort the finished design. Step 4: While holding the stencil down, remove the tape and gently peel the stencil away from the item you are decorating. Step 4: Allow the joint compound to dry 48 hours before painting. Joint compound dries pure white which is fabulous on some items. Simply seal it with clear, polyurethane to protect the raw compound and prevent chip damage. If you prefer, you can tint the wet joint compound to your desired color by using pure pigment tints. Some home stores carry various brands or we found great sources on-line. Simply do a search for “pigment tints” Remember when adding tints that your final color will be slightly lighter. The dried design can also be painted with any wall or craft paint when you want your design to be the same overall color as the piece you are working on. Adding a paint finish to the design only can be achieved by simply replacing the stencil over the dried compound before painting. This protects the underlying surface. To make a design unusually glamorous, try inserting rhinestones or decorative beads in to the wet compound or medium before it dries. Gold leafing is another option for creating an opulent design. Inexpensive kits are available in your local craft store. The types of unique gifts you can create with this decorative method are endless:Consider finishing a group of inexpensive frames in your favorite design and then paint them antique gold or silver. Insert recent family photos to give to parents or grandparents. Add an elaborate raised design to a simple wooden box, paint it black, replace the stencil over the design and paint the design only in gold. Line the inside with red velvet for an elegant jewel or keepsake box. Plaster stencil a central design on to a set of inexpensive canisters as a gift for a friend who loves to cook. Do the same with ceramic pots, paint them bright colors for the garden lover. By adding white glue to the joint compound, you can now add a plaster design to a glass vase then prime and paint to create a one of a kind vase for the flower lover in your family. Plaster stencil a frame around a solid piece of wood, paint to a lovely cream color then add then paint the word Welcome in the center. Friction and heat builds between the chain and guide bar without oil. The oil also helps the individual links in the chain operate smoothly at high speeds. Check the oiling system prior to every use. Tighten all of the screws and fasteners. This process should be done before every use. Before using your chainsaw each time you need to inspect the fuel system. After every 10 hours of use you need to clean or replace the air filter. Byreplacing the air filter on a regular basis your chainsaw will be able to run cooler and use less fuel. The sprocket tip should be lubricated after every 10 hours of use. You will know that lubrication is complete when a small amount of grease appears at the edge of the guide bar near the sprocket. For every 10 hours of use the guide bar should be turned. Flip the guide bar over to promote an even wear pattern on the bottom and top of the bar. Inspect the spark plug after every 10 hours of use and cleaned or replaced as necessary. The spark arrester screen prevents sparks from leaving the exhaust port and hurting the operator or falling on flammable materials. The fuel filter should be replaced after every 20 hours of use.
